1. Acceptance of Terms
By accessing or using CargoGauge, you agree to be bound by these Terms of Service and our Privacy Policy.
2. Service Description
CargoGauge provides logistics management software including real-time GPS tracking, ETA calculations, and fleet management tools.
3. User Responsibilities
- Maintain confidentiality of your account credentials
- Use the service in compliance with applicable laws
- Have a lawful basis for tracking the drivers you track, and tell them that you are doing it. Which basis that is, is yours to decide and yours to defend; see section 4 of the Privatlivspolitik
- Provide accurate information
4. Data Usage
You retain ownership of your data. We process data as described in our Privatlivspolitik. We may use anonymized, aggregated data for service improvement; section 7 of the Privacy Policy explains what is aggregated and why it can be kept.
5. Data Protection and the Processing Agreement
For the personal data you put into the platform about your drivers, your staff and your work, you are the controller and we are the processor. Section 2 of the Privatlivspolitik sets out where that line falls, including the smaller set of data we control ourselves.
Our Databehandleraftale governs that processing. It is published in full, it forms part of these terms, and it applies to your use of the service whether or not a separate copy has been countersigned. Where these terms and that agreement disagree on a question of data protection, the Data Processing Agreement prevails.
Your obligations as controller are yours: having a lawful basis for tracking the people you track, telling them about it, and answering the requests they make to you. Section 9 of the Data Processing Agreement sets out what we do to help you do that, including what happens when one of your drivers writes to us instead of to you.
6. Service Availability
We strive for 99.5% uptime but do not guarantee uninterrupted service. Maintenance windows will be communicated in advance when possible.
7. Termination
Either party may terminate the service with 30 days notice. On termination you may ask us for a machine-readable export of your data, and we delete what we hold for you. Section 11 of the Databehandleraftale is the detail: what the deletion covers, when it happens, and the two things that survive it because bookkeeping law and our own accountability require them to.
8. Limitation of Liability
CargoGauge is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages.
9. Governing Law
These terms are governed by Danish law. Disputes shall be resolved in Danish courts.
